Baba Terms of Use

These Terms of Use ("Terms") are an agreement between you and Baba Apps LLC ("Baba Apps," "we," "us"). They cover your use of our website, www.babaapps.com (the "Site"), and the mobile apps we publish (the "Apps"). Together we call these the "Services." By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
1. Grown-ups are in charge
Our Apps are made for children to enjoy, but they are meant to be downloaded, purchased, and managed by a parent or legal guardian. If you are a parent or guardian, you accept these Terms on behalf of yourself and your child, and you are responsible for your child's use of the Services. If you are under 18, please have a parent or guardian review these Terms with you.
2. Privacy
Our Privacy Policy explains how we handle information, including information about children. It is part of these Terms.
3. License to use our Apps
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the Apps on devices you own or control, for your family's personal, non-commercial use. You may not:
- copy, modify, distribute, sell, or rent the Services or any part of them;
- reverse engineer, decompile, or try to extract the source code of the Apps, except where the law allows it;
- remove or alter any copyright, trademark, or other notices;
- use the Services for any unlawful purpose or in a way that could harm the Services or other people.
4. App store terms
Apps downloaded from the Apple App Store or Google Play are also subject to that store's terms and policies. If there is a conflict between these Terms and the app store's terms about your use of an App, the app store's terms control to the extent of the conflict.
Apple users: These Terms are between you and Baba Apps, not Apple. Apple is not responsible for the Apps or their content, has no obligation to provide maintenance or support, and is not responsible for any product claims, including claims that an App fails to meet legal or regulatory requirements. If an App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, and to the maximum extent permitted by law Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
5. Purchases and subscriptions
Some Apps offer paid downloads, in-app purchases, or subscriptions. All payments are processed by Apple or Google, under their terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and you can manage or cancel them in your app store account settings. Refunds are handled by the app store according to its refund policy. Prices and available content may change over time.
6. Our content
The Services, including all characters, artwork, music, sounds, text, software, and the Baba Apps name and logo, are owned by Baba Apps or our licensors and protected by intellectual property laws. Except for the license in Section 3, these Terms don't give you any rights to them.
7. Feedback
We love hearing ideas from families. If you send us suggestions or feedback, you agree we may use them freely, without any obligation to you.
8. Links to other sites
The Services may link to websites or services we don't control, such as app store pages. We aren't responsible for their content or practices, and your use of them is governed by their own terms. In our Apps, links that leave the App sit behind a parental gate.
9. Changes to the Services
We are always working to make our Apps better, so we may add, change, or remove features or content, or discontinue a Service, at any time.
10. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Baba Apps and its members, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or US $50.
12. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Baba Apps from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services or your violation of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Colorado, and you and Baba Apps consent to their jurisdiction. If you live outside the United States, you may also have rights under the consumer protection laws of your country that these Terms cannot take away.
14. Termination
You can stop using the Services at any time by deleting the Apps. We may suspend or end your access if you violate these Terms. Sections 6, 7, and 10 through 15 survive termination.
15. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Baba Apps about the Services.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the effective date above. If you keep using the Services after an update takes effect, you accept the updated Terms.
